PLEASE READ THIS AGREEMENT CAREFULLY; THIS IS A BINDING CONTRACT.

Welcome to the Metaphysician.Design website. These Terms of Service describe the terms and conditions under which @metaphysician (Shannon Tawn) provides you access to the site and any associated services. 

These terms may be amended at any time, and you agree that you continue to be bound by any changes made to this ToS. For your convenience, the date of last revision is included at the top of this page. I may make changes to this site at any time. You understand that I may discontinue or restrict your use of the site or my services for any reason and without notice at any time.

YOUR USE OF THE SITE AND MY SERVICES SIGNIFIES THAT YOU AGREE TO THIS TOS AND CONSTITUTES YOUR BINDING ACCEPTANCE OF THIS TOS, INCLUDING ANY MODIFICATIONS HENCEFORTH.

GENERAL TERMS AND DISCLAIMERS

1. You must be at least 18 years old to purchase artwork from me.
2. I reserve the right to share commissioned work for self-promotional reasons unless specifically requested to keep a finished work private.
3. I reserve the right to refuse service to anyone at any time for any reason. I reserve the right to blacklist any customer at any time for any reason. 
4. My work hours are between 10am and 7pm Tuesday - Friday. I will not be painting your commission outside of these hours, and you should not expect updates. 
5. You must be in full compliance with the provisions of this ToS and any usage guidelines or policies that may be provided by myself from time to time (all of which may be modified from time to time in our sole discretion).
6. My preferred method of contact is via Discord @meta.physics. Alternatively, you may email me at MetaphysicsDis@outlook.com.
   1. Upon contacting me, please allow at least 48 hours for a response time.
7. Throughout the art process, I will provide updates for the sketch, flat colour, and rendering milestones, as well as any other updates I deem necessary or are requested.
   1. Updates are only given after full payment is given and a sketch has been approved.

RESTRICTIONS AND CONDITIONS OF USE

1. No Violation of Laws. You agree that you will not violate any applicable law or regulation in connection with your use of the Site or my services. Without limiting the foregoing, you agree that you will not make available through the Site or my contact any material or information (including, without limitation, Content) that infringes any copyright, trademark, patent, trade secret, or other right of any party (including rights of privacy or publicity).
2. No Commercial Uses. You agree that you will not use the Site or my services for any commercial purpose or the benefit of any third party or charge any person, or receive any compensation for, the use of artwork purchased from me without first purchasing a commercial license.
3. No Machine Learning. You agree that you will not use any content on the Site for machine generative learning, non-fungible tokens (NFTs), or for any other generative purposes. None of my licenses cover this, or permit you to do this.
4. Artwork that is created to your order is owned by me unless you purchase a one-time full ownership transfer license. You agree that subjects within the paintings are owned by you, are explicitly from a copywritten service such as movies, television or video games (considered ''fan-art''), or that you have express permission from the subject owner to paint their material.
5. Artwork purchased is for personal use only unless otherwise purchased alongside a license. This includes:
   1. Profile pictures on social media/messaging platforms.
   2. Profile pictures on video game platforms.
   3. Personal publishing/sharing with credit on social media services or communications platforms such as ''Instagram'', ''X'', ''Discord'', and ''Facebook''. 
   4. Personal projects such as private websites, Discord server branding, and worldbuilding wikis.
6. All examples of artwork being shared without an ownership transfer license must be accompanied with credit in the form of contact methods and website links.
7. This site and my artwork are protected by UK and International copyright laws. Except for your use as authorized above, you may not modify, reproduce or distribute the content, design, artwork, or individual sections of the content, design, artwork or content without my express prior written permission.

PAYMENT INFORMATION AND PRIVACY POLICY

1. Payments are processed using the service ''Stripe'' through this website or via a Stripe link exclusively. You can request for a custom payment link to be created temporarily with your specific products if you wish. I can also deliver an invoice via email address. Stripe can accept payment from:
   1. Direct Bank app or Card transfer
   2. Revolut
   3. Klarna
   4. Link
   5. Google Pay
   6. Amazon Pay
   7. Billie
   8. PayPal is currently pending as a payment option.
2. Prices and payment are in GBP. Where transfers are inaccurate, you may be requested to send additional cash to meet the expected full price in GBP. In the United Kingdom, where my business operates, Stripe requests a service fee of 1.5% + 20p which will be taken into account when considering requesting additional payment. You will not be asked to cover the service fee and this is considered a business fee on my end. You may be automatically charged a currency transfer fee if you are not paying in GBP. This is considered an additional charge and is a personal fee that must be covered by yourself.
3. I only accept legal tender as payment. Methods such as Steam wallet, Discord Nitro, ''exposure'' or ''art trade'' are not accepted.
4. Due to disputes with payment processors, I am no longer offering payment plan services. Payment must be offered in one. I apologise for any inconvenience caused.
5. Payment must be delivered by at least the end of the sketching phase. If payment is not delivered by this point, your piece will be held on the waiting list until payment can be offered; it will not be completed until full payment has been received.
6. You agree to, and are expected to, pay the full listed prices. Discounts are only offered by me and cannot be requested. Do not commission me if you cannot eventually pay in full. If at any point during the process you inform me you cannot pay full price, your commission will be cancelled without refund or work shared. 
7. Information such as emails, legal full names, and addresses may be shared through invoices and receipts. This information is legally required for payment tracking and ledger purposes and as paperwork evidence of transaction and delivery of goods. This information is never shared with third parties and is private between you and myself. Do not share my own private or personal information either.

CANCELLATIONS AND REFUNDS

1. Refunds can be offered at any point before a sketch has been approved. After a sketch has been approved, no refunds will be offered.
2. Refunds are only offered for Flat Colour tier and up.
3. A full sketch is not sent to you until payment has been confirmed.
4. If after you have paid you do not approve of the sketch, you can request a partial refund equivalent to 70% of the total price, valued equivalent to the work spent on the initial sketch, and you may keep the sketch.
5. You have the right to cancel your commission slot at any point prior to the sketch being approved.
   1. If you have paid in full before a sketch has been sent to you, you can request a full refund valued at 100% of the total price. You will not receive the sketch.
6. Seasonal SKEB tickets are non-refundable at all tiers.
7. Attempting to force a chargeback will result in permanent blacklisting.

REVISIONS AND EDITS

1. Small revisions and edits during the process (adjustments, repairs, liquified adjustments, hue changes, etc.) are free of charge.
2. Clients are entitled to 3 free of charge major revisions. Following this:
   1. Major edits come with a minimum fee of £10, more depending on the edit complexity. 
   2. All edits after commission completion come with a minimum fee of £20. 
3. I cannot guarantee I will be able to edit or change a finished commission. 
4. Please ensure all descriptions and reference images provided before sketching begins accurately represent the piece you'd like to see.
